Civil litigation refers to the legal process in which two or more parties engage in a non-criminal legal dispute, seeking resolution through the court system. It encompasses a wide range of legal matters, including disputes over contracts, personal injury claims, property rights, employment issues, and more.
The process of civil litigation typically begins with one party, known as the plaintiff, filing a complaint in court against another party, known as the defendant, alleging that the defendant has caused harm or violated their legal rights in some way. The defendant is then served with the complaint and has the opportunity to respond by filing an answer or other legal documents.
Once the initial pleadings are filed, the parties engage in a series of pre-trial procedures, which may include discovery, where each side gathers evidence and information relevant to the case, and motions, where either party may request the court to make a ruling on a particular issue.
If the parties are unable to resolve the dispute through settlement or alternative dispute resolution methods, such as mediation or arbitration, the case proceeds to trial. During the trial, both parties present their arguments and evidence to a judge or jury, who will then render a verdict based on the facts and applicable law.
